Old Sidewalks

waltship said:
My neighbor just had his property surveyed a couple of months ago. He told me he lost some ground after it was done. The recorders office told him that instead of owning to the center of the street, he now owns from the inside edge of the sidewalk. The town owns the sidewalk and the grassy area between the street and the sidewalk. That is what he told me, I don't know if it true or not. Maybe, if you're not sure, you should check. We live in Ohio.

yep I am in Ohio and like I stated earlier the mayor's office told me the property pins in our town are on the INSIDE of the sidewalk, the homeowner does NOT own the sidewalk or strip of grass, and they said it was fine for me to detect.

If I saw someone with or without a metal detector in my front yard digging a hole I'd go through the roof and read them the riot act, and probably call the cops.

Quibbling over who "owns" it is useless. It's about the perception.

I also subscribe to the rule of do unto others as you would have done unto you. I would like people to ask before showing up on what I think is my property (perception, may or may not be reality) and digging or even sitting in a lawn chair. Since that is what I would like others to do, that is what I do myself.

We have enough lack of politeness and rudeness and people barging around these days. I'd rather ask politely and be told no, than to assume it is ok and have someone be upset.

There are tons of places to detect, one lawn, one sidewalk strip, is it really worth potentially getting someone angry?

I know of a suburb where the parks are off limits to detecting because of ONE rude guy who insisted it was his "right" to be there. He argued with the mayor and guess what, the next council meeting the ban was passed and that was that.

You catch more flies with honey than vinegar.
Choose your battles wisely.

Kindness begets kindness. Anger begets anger. I know what I'd rather be getting.

If I notice someone watching me I will always engage them. Even if just to smile, wave and say hello.

People are naturally apprehensive when they see strangers doing something out of the ordinary, ignoring them doesn't ease their apprehension.

When people see I'm friendly (and therefore non-threatening) they are almost always friendly back to me.

The bonus is it often leads to me being given permission to detect somewhere else.

To me this is just common sense.

I am the same way. I will stop and be friendly with any one

who comes along. That's assuming that it's not a lot of folks.

If it is a lot of folks, you can bet I will engage with some of

them.

No one ever bothers me like I hear other MD'ers talk about.

I think it's my demeanor. I'm older, friendly and harmless.

I was doing a tot lot one time and talked to the kids and parents.

I ended up eating a wonderful meal they had prepared.

Free eats and detecting, how can you beat that?

Happy Huntin,

Tabdog

If you don't get permission first, then Stay Out of Other Folk's Yards!
Here in my town of Houston, the majority of home owners, even
those with unkempt yards, are VERY jealous of their yards. If they
see you on it or heaven forbid, Digging in it, you'll be answering to
the local police! Any excuse you use won't matter, since that
home owner believes, wrongly or not, that every square inch of
that yard belongs to him alone! And with the strong Texas Trespass
Laws, you can even find yourself looking through bars! The times I've
asked the owner for the OK, the reply I got was always typical:
"Not NO, but H**L NO! Who do you think you are? I don't know you!"
So get out of my yard with your Bull***T and don't come back!"
Sorry, but that's my experience guys, so take care!
