Old Sidewalks

Why do they need to be mutually exclusive?
 
I know where your coming from Tom. But what if you woke up and looked out your blinds only to find that same soccer Mom cutting a plug? I personally wouldn't like it. (Well if she was hottie I would help her dig) Even though I knew good as well she could do it. Would you let her? I wouldn't. I know that sounds bad. But I would tell her to move on. I used to just stop and dig. But now I believe it's better to ask. It's hard to ask because I hate a "no" answer. But when my wife is talking to one of her friends that live in an old house I tell her to ask. It works every time!
 
I agree 100%%%%% Just because we mow it, weed it,trim it or whatever the case may be it is city property. If you think permission is needed then ask the city, not the home owner!
 
Normally the city owns 35' either side of the street from the center of the street! This usually includes the walks so there should be no problem with hunting them!!! I pay taxes......do YOU???
 
Sounds good on paper. But how would you feel if someone was digging on your well manicured weed free city owned property? I'm really not disagreeing with you but I certainly wouldn't like someone digging on my perceived property.

Hell, I've been working since I was 13 years old, I'm 61 now, what do you think? I've been retired for 6 years, yeah I have paid my shares of taxes. You guys have blown this way out of proportion. I never made any mention of asking the homeowner for permission, read my post again, I just merely wanted make him aware of what I was going to do, I don't like to have someone come out to me and get defensive. Maybe the moderator needs to delete all these posts, It's gotten ridiculous. Good hunting to all.
 
Hey John, looks like your thread got hijacked! Don't take it personally.

Looks like you've got a nice to place to hunt. Whether talking to that gentleman was necessary or not is really beside the point of your post. I think you done good and who knows, that nice gentleman may be a lead for other good sites to detect.

You seem to getting upset by all this, so I'll start a new thread for my 2 cents.

Yeah, it may not have been the point of the original post, but it was an interesting topic to discuss. No harm in hearing each other's views on the subject.
 
hi john, congrats on getting permission to hunt some old sidewalk real estate. they can be very productive. i think you'll do well, and end up with a lot of sidewalk to do. despite the large number of posts and responses, there seems to be some unanswered questions regarding the rights of us detectorists to hunt a combination of public and private property - it can be done - the same way you did it.

i have read most of the answers to your post, and feel compelled to answer. in my nearly thirty years of detecting, i have always found it to be much to my advantage to ask permission of the owners, whether they are private, county, city, etc. some cities own all of the sidewalk and a couple of feet on each side of it; some cities own only the sidewalk and the road frontage; and some cities own only the sidewalk itself. it then becomes our responsibility to find out the true owners and secure permission to hunt. one trip to city hall will settle this question. ignorance of the law is no excuse. i commend you sir, for taking the time to find out for yourself.

let us not be negative and disagreeable on this subject. it looks pretty clear cut and simple to me...property rights should be respected, and we should ask permission to detect, no matter where we are. nothing less will do. we have a good image to project and protect to the non - knowers. i do wish you luck on your quest, john, and hh,

When I bought my house in California, I actually read all bazillion pages of the property deed and other associated paperwork regarding the home. It stated that the property line actually went to 6' in front of the sidewalk into the street. That's right, I technically own the land the sidewalk and part of the street are built on, and I pay property taxes on it. There's also an AT&T utility b-box on my property (I should be getting a kickback from them).

However, I do not own the physical sidewalk and street itself, nor am I responsible for their maintenance.
 
Most people own to the center of the road and

pay taxes on that.

Just think of the people on a corner of the block.

They have to pay taxes on the R/W in two streets.

Their taxes are higher because of that.

Look official. Wear a dark blue workers uniform, have a clip-board hanging from the belt.
 
My neighbor just had his property surveyed a couple of months ago. He told me he lost some ground after it was done. The recorders office told him that instead of owning to the center of the street, he now owns from the inside edge of the sidewalk. The town owns the sidewalk and the grassy area between the street and the sidewalk. That is what he told me, I don't know if it true or not. Maybe, if you're not sure, you should check. We live in Ohio.
