eBay listing: "Don't buy this Tesoro detector"

Interesting eBay item: "Don't buy this Tesoro detector" shows Tesoro detector picture. Goes on to read "don't buy Tesoro products, discriminates against US dealers who sell to european customers". Obviously there is some history here but I'm clueless. Who knows what this is about?
 
First i think EBay isn't the right place to protest against Tesoro.
I know it isn't allowed for US Tesoro dealers to sell
out of the states.
But it would be great if it was because Tesoro detectors cost a lot more in Europe.
So US Tesoro dealers could make a lot of money shipping to Europe and the customers would be happy to pay the extra shipping costs.
Example:
AN Eldorado in the US sells for 375$ that is about 300 Euro.
In Germany the same detector is 600 Euro at the cheapest dealer.Twice as much!!!!!!!
A few month ago it was 800 Euro.
Even if the shipping is about 30$ with USPS and tax
and custom can be 20 % of the detectors value it would still pay of to buy in the US for a European customer.
I think every company should support free trade.
I am German living in the US and very happy because i can buy my detector here.

Andy has hit the nail on the head and don't forget lifetime warranties drop to one or two years in Europe (not just for Tesoro, also Fisher, Shadow).

The dealer who posted the listing on ebay, VOLUNTARILY signed a dealer agreement stating that he was not to ship outside of the USA or Canada. He sent detectors into Europe and got caught. We canceled him.
I guess I don't understand why he is upset because HE couldn't keep his word.

Working for a US Distributor(not Detectors). I can not agree that ebay as an international market place should be wide open!
I hear a lot of people complaining about their jobs going off shore but they complain that international trade should be wide open and put their employers out of business? Does this make sense?
There needs to be a level playing field in each market to assure everyone has jobs and product available. Tesoro does that in North America and in international markets.
As James said,if you sign a contract with specific restrictions. Don`t make a public statement that you can`t or won`t keep your word and Bash the very people with who you broke your contract.

When you purchase a Tesoro detector in the UK, or anywhere in Europe, you still still have a lifetime warranty with Tesoro, but the detector needs to be returned to the factory for service. You pay freight both ways. The UK Importer gives you the "short" warranty you complain about to keep your costs down. Remember that the money he spends doing this is additional cost that comes out of his pocket.
 
Seems like today that contracts are not only meant to be ignored, but the person of no integrity who Breaks the contract.....Can go on the offensive and belittle the folks who abided by the contract. It's a funny world, but anyone with any sense can see through this kind of thing. This example from Ebay and other recent contract breakers who have been caught, fired and then belittle the boss who had faith in them are small little fellas. Cretins as Jack would call them <img src="/metal/html/lol.gif" border=0 width=15 height=15 alt=":lol"> Good luck with this clown you guys!
 
As you are aware, I e-mailed you with questions regarding this issue. You have not got back to me on this, and I'm happy to drag this sordid affair into the public domane if you wish. You say that the dealer in question signed a 'VOLUNTARY' dealer agreement. I assume this 'VOLUNTARY' agreement means that if dealers DON'T agree to sign this so called 'VOLUNTARY' agreement document, then Tesoro will NOT supply them with detectors, am I right?
What's the problem with dealers selling your detectors to whoever they wish, regardless of what continent the customer happens to be residing on?
Could it be that Tesoro / Laser want to keep all the huge profits to themseves? You had better get back to me James with some feasible answers to my questions, or I will shred you in public. This was not a contract as such, simply a 'VOLUNTARY' agreement. Now then, a voluntary agreement as such, does NOT impose restrictions on the secondary vendor of the product... if it does, then it is NOT a 'voluntary agreement' it is a 'LEGALLY BINDING CONTRACT'. If secondary vendors refuse to sign a so called 'VOLUNTARY AGREEMENT' and are then refused the goods from the primary vendor, then this makes Tesoro's 'VOLUNTARY AGREEMENT' a leagally binding contract. Come on James, what's the deal here! <img src="/metal/html/biggrin.gif" border=0 width=15 height=15 alt=":D">
 
I guess my definition of agreement and contract are about one and the same thing. If I shake a persons hand (Literally or not)and say I'm going to abide by something, he can take that to the bank. And, I expect to be able to take his word (Legal or Not) to the bank as well. Maybe I'm just too old fashioned for the new Pepsi Generation way of thought. <img src="/metal/html/lol.gif" border=0 width=15 height=15 alt=":lol"> You may possibly be legally correct Charlie, I don't know, but I'd rather deal with people who feel the same as I do. And if I owned a business that I put together with MY blood, sweat, tears and Cash....I'd demand that type of employee and be that type of employer. HH
 
I am a Tesoro dealer ( very small ), I became one not to make a large amt. of money, but hopefully to teach each new user how to dig, where they can and cannot hunt,to always get permision, and the ethics and responsibilities of detecting,in hpoes of preserving the hobby. I tend to veiw, people who ignore their contracts as the same people who trespass, leave open holes, trash on the ground,sneek in to banned sites and other wise destroy the hobby for the rest of us. as they clearly do not have any ethics and honor nothing that they have agreeded to. My two cents worth

I didn't know they had bears in the UK.
I am a Tesoro dealer here in the States. I cannot and do not ship units overseas. You know why? Because I agreed not to when I signed my dealer agreement with Tesoro. Was my signature voluntary? I think so, I was the one moving my hand. The dealer in question should not have been shocked that his contract was terminated - he was the one that violated the terms he agreed to. I don't know all the reasons that Tesoro has that in the contract, and frankly I don't care - I was agreeable to the terms and it is my responsibility to abide by them. If I did not agree, I would not have signed the contract.
Tesoro and the Giffords have shown me that they understand the value of a strong dealer network. It is important to Tesoro and important to the individual dealer. If they let several large dealers do whatever they want, it would eventually destroy the small dealer here in the States. If they let the dealer here in the States undercut the overseas dealers, it would eventually destroy the dealer network overseas.
I do not know all the reasons that detectors are so expensive in Europe, but they are. Would I like a piece of the European market? Sure I would, but I don't because I agreed not to. It is that simple.

I still don't see how this arguement works re destroying the overseas dealers.
I don't know what your profit margin is but you could multiply it up four or five fold if selling to the 'protected' U.K. market. If it was an open market the European price would drop and the dealers over here would have to manage on a profit of perhaps only double what you make. Why not ?
The present situation only leads to grey imports or the more wealthy who come over to the U.S. to visit Disney or stay in their holiday home a few times a year bringing machines back (its called the holiday subsidy and can pay for the flight).
A family man struggling to pay the bills has the choice of a second hand detector with no warranty or a brand new/couple of hours use 'grey' machine with no U.K. warranty that costs the same or less. Either way the U.K. dealer has priced himself out of a deal.
 
I am a recent college graduate of business studies and I am with you 100% on this Jack. Anyone entering a franchise agreement MUST abide by all of the AGREED TO terms or risk loosing their franchise. Territorial agreements and pricing restrictions set an even playing field so that the "big boys" cannot run "mom and pop" stores out of business. I would rather deal with a friendly, knowledgeable shop owner any day than a cold corporation and applaud your decision to franchise in this manner!
Childish antics such as these show a lack of business ethics. If the dealer wants to challenge his franchise it should be done through legal channels rather than public forums.

I'm happy to admit that I missed the point first time round, and I now offer sincere apologies to James, and anyone else here who I may have offended with my 'uninformed response'. <img src="/metal/html/cry.gif" border=0 width=40 height=15 alt=":cry"> As you read this, I am beating myself with a big stick <img src="/metal/html/shocked.gif" border=0 width=15 height=15 alt=":shock"> (OUCH)!
