Danger to Metal Detecting in Florida

Become a( Certified Archaeologist ) and enjoy the same protection,laws and benefits thru the (University of Home School ) . Just Print out your Diploma and carry it with you at all times.
 
Those archies are just @#$%& off that all the cool stuff is in Europe and all they have to dig here are Native artifacts. As far as "future generation's history" As far as I'm concerned pretty much everything in the new world has already been documented on how it was used and impacted daily life. They all need to either be happy with what they have to work with or relocate to a place that has an older civilization.
 
Can SEN. HAYS and the ARCHAEOLOGIST EXPLAIN the Human remains at the 9 / 11 Dump site. Oh! Didn't Think So...... No money in it.
 
I really appreciate all the replies I gotten to this post. BUT please write to Senator Hays on his facebook page, we have to defeat this while it is still in its infancy. We [the hobby] can't afford for this to get out of hand.
 
as Americans, we should NOT have to tolerate this kind of political b.s. redtape. yet, here we are. because "they"(politicians) know what is best... next thing you know, it will be illegal to breathe air
 
Why doesn't someone post the Senate bill number so we can read it, if this is for certain real let just kick their butts with e-mails and letters. We had a similar issue in our area where a city was going to stop all detecting, ( large civil war fight in town) due to some idiot statements from a local ARCHAEOLOGIST that new absolutely nothing about detecting. We started a local and nation wide campaign and got real results. Its remained open and we will now be working with the local museum in recovering future items for display;

No, there is a lot of panic and misinformation bouncing around the internet. It has just passed out of one committee. It is headed for another committee and then to the floor eventually for open debate. Then the governor has to give his yes or no. The noise we have been making has already resulted in some wording changes to the bill. A small step in the right direction. There are still more opportunities to achieve changes or outright killing it.

Some things that are NOT helping are people making threatening and insulting posts on the politicians facebook page. This just paints us as a bunch of loonies and cooks who probably DO need to be regulated. When you contact these people you need to make every effort to sound intelligent, reasonable and a solid citizen with serious concerns. That will get you more attention then a string of abusive and insulting language.

This is a long ways from being over.

What triggered this was some fools digging pits you could hide a person in standing up digging for relics and then leaving them along with some other destructive practices on some govt land that they couldn't put an end to. So they decided to put an end to it and in typical style they are using a very broad brush. We need to look like reasonable citizens concerned about the problem and the overbearing solution.

This bill will not end metal detecting in Florida but it is rather poorly written in my opinion and the wrong people in power could use it to make trouble for us. So we work in the system to put an end to it, not write insults and threats on facebook.
 
About five years ago, Florida enacted a law restricting private persons from taking archaeological artifacts from stream beds and gravel bars. It does not surprise me that the state would continue to tighten up its cultural resources protection.

That said, I have read the test of FL SB 868 (which has not been enacted, by the way) and I do not believe the sky is falling here.

The language restricts one from disturbing archaeological sites or archaeological material from public land or from private land designated a "special zone" -- like a historical district. What I find unclear is what the proposed law would define as "archaeological material." Unfortunately, Florida casts a pretty wide net over what it considers to be archaeological material -- "objects which have intrinsic historical or archaeological value relating to the history, government, or culture of the state" from Fla. Stat. 267.115.

Under this definition, I do not believe that coins or jewelry fit the definition. However, Civil War relics and pretty much any homestead or shipwreck relics would.

Now, Florida already has a law on the books that prevents nearly the same thing as SB 868. The current Florida law in its entirety is here:

267.13 Prohibited practices; penalties.

Great News about the withdrawal on the Florida Bill and I believe it was certainly influenced by the responses of MDers

Could you imagine if we were not clued in and then confronted with these "Law Changes"?!

I know these posts are not "FUN" but they are certainly necessary

This is just another step in the wrong direction. Putting your hopes and dreams in government will cost you your freedoms. That's why we have liberal do-goods telling us what we can eat, how we should think, what we need to feel guilty about, and so on. They think they are smarter than you and that's why they want to spend your money, tell you how to live, and so on. Any time you look toward government for answers this is the kind of stuff you'll get.
 
Always, the MD community has tried to appease, get along and be friends with the Feds, and these Archs. It hasn't worked and it will not work. Magazines, clubs, manufacturers, organizations, and forums like this need to play a little harder with the Feds, or, like Critter said above, it will all be over for us.

The Feds and the Archs do NOT want to be our friends. Wise up.
