Have good recovery techniques. I was at one of the public spots I metal detect yesterday. I was not detecting but I was talking to one of the people that work there. They know I also metal detect. I was told that the place had to pay for a persons medical bills because this person claimed she fell in a hole that was not properly covered up and had to have suregery, etc. Apparently it must have been quite a bit of money. The person I was talking to showed me the pictures of the hole. I admit it did look like a plug, it was round but was only about 4 inches wide. The hole had been filled in but must have settled a little. I still do not see how someone could have actually tripped in the hole but who knows.

The person that worked there told me that they blame the hole on someone that was metal detecting. I tried my best to defend people that metal detect but we all know there are some out there that do not do a good job and do get areas closed for everyone. Hopefull this area does not get shut down because of this. So this is just a reminder even for myself to make sure we do the best we can when digging a target to make sure our public or even private places we hunt don't get closed.

Mercy! Whats a guy to do? I could see if it was a "pit" but not some little hole the size of a coffee cup!...sheesh, those kids on the beach dig some pretty monstrous pits, thats a public spot, could a guy sue the city?

Judges should use a bit of common sense, a hole that small could have been caused by anything from a squirrel to a maintenance man..and told the person with the claim too bad, go on about your life and pay attention, then fined them 1000 bucks for wasting everybodys time....then the Judge should fine the lawyer representing the case10,000 bucks, or pulled his license. Man, what has this World come to?:sadwalk:

I don't like to hear things like that. Sometimes we do get a little sloppy, but the little critters dig holes and don't cover them. The kids dig big holes in tot lots and don't cover them.. During the summer here when I see someone detecting around a park, I tell them not to hunt in the playing field until the season is over. Anyone could trip over a bad plug. That would stop it for all of us. The nice thing is that they all agree about not hunting the playing fields.. After season it is fare game... KEN

As long as people keep getting money they will sue.

My wife was a manager of a housing project and a cop was chasing a drunk on foot through the area, the drunk cleared plastic chain up for decoration and the cop didn't make it.He sued and settled for something like 14k.

In the park I hunt, I notice holes that squirrels leave and they do a lot more damage than we do, but if somebody falls in one I am sure we would get the blame. If those squirrels leave any dirt around I push it back in the hole and I also doctor up a lot other holes made by coin hunters.

Mudpuppy is right, I think some judge,s need replaced, some lawer,s need shot. This is getting out of hand. People think they can get money and a lawer uses his to rob people.

I have a friend that works in a restaurant near the courthouse..says the lawyers and judges are in there all the time drinking together and yukking it up about the cases...no doubt they are all in cahoots...pat each other on the back with the rulings...heck, insurance guys could possibly be a part of it too...if no frivolous suits were adjudicated, then nobody would buy liability insurance either...I guess the best thing is to not have anything worth getting sued over. Its really weak for that outfit to blame the hole on a metal detectorist...
