Bought Explorer XS on eBay got ripped off!

I saw an Explorer XS on eBay described as being in "excellent" condition (eBay auction 1238120704 for those interested). Well the guy ripped me off! The unit he shipped me was junk! Very, very used, appears as if it has been under water, scratched, dented, cracked, etc.
The guys name that ripped me off is Ryan Monoski in South Williamsport, PA and his email address is bmonoski@aol.com He may have more junk to sell so beware of this guy!
It's a shame that someone like that would cast a dark cloud on a group of people (treasure hunters) that I've found to be very honorable!

According to eBay policy, you can give him a negative feedback and, since the item was not as advertised, return it and demand a refund.
 
Yes, I did leave negative feedback for him. He refuses to take it back, and I hesitate to just send it to him. I'd probably end up with nothing at all!
He won't even answer my e-mail messages anymore!
 
Don't give it up without trying it out.It might work just fine.I know you didn't want to shell out the bucks for a beat up one,but you got it now,might as well give it a whirl.
Send it to minelab,they will replace the housing with the new non cracking one on all the Explorers,even the ones purchased used.I also read that they replace all of the plastic when they do.They probably have to replace the screen when they do that.You just have to pay the shipping,and yes I know you did not buy it to spend more on it.Give Minelab Las Vegas a call and ask.

You could always pay a nominal fee to an attorney to send him a letter. Might just get him to refund the cash. To actually file a suit would be difficult as you'd need to go to PA most likely and go to small claims court. Could also file for your expenses and time from work, etc.
I know you probably don't want to keep going with this but it is still an option for the letter.
I really hate reading about this sort of behavior. Good luck and do give minelab a call.

If he sent it to you through the us mail thats mail fraud .you can turn him in to the postal athorities .Make sure you save the shipping package they will want it.
 
Don't give up. Contact eBay directly and explain the problem. I'm not sure whether eBay will get your money back, but at the very least I would expect them to kick the bum off their sellers list.
 
If you know someone who lives near him,ask them to go and talk to him.I find in these situations that using sign language (a punch in the face) works well. <IMG SRC="/forums/images/smile.gif" BORDER=0 ALT=":)">
 
Send the jerk an email or letter and tell him you gassed the auto and are on your way to return one XS, they do make nice neck ties when wrapped correctly around the neck of the seller.
 
It's O.K. to leave neg feedback on ebay, but, contrary to what most people think, it's not three strikes and you're out. What you have to do is report the problem to Ebay's fraud division, as your transaction will be covered, I believe, by the Lloyds company. (it's over a certain amount of $, so it's covered, I had to go through this process on ebay once myself). You have to make copies of his ad, and all messages back and forth between you, and you MUST include headers on these messages. I forgot the name of the formal complaint you are making (it's not neg feedback, which is worthless) ,but this formal complaint will go twoards having him removed from the board if he receives three of these. Ebay will follow up on this to get a return of your money, but it involves going through many threads. Good luck, John I.
 
First off thanks for everyones comments, and suggestions!
I have filed a fraud report with the US Postal Service, but haven't heard anything so far.
I will also report it to eBay fraud department, but you have to wait 30 days before filing a claim.
The insurance only covers up to $250.00. I paid a total of $727.00 for the "excellent" unit.
I appreciate everyone that took the time to let this guy know what you think!
 
Don't give up. Before it's through, he's going to be sorry he ever messed with you.
 
Maybe we could rent a bus and all us XS"er could go pay him a visit, I would be hard to argue with a busload. Sure hope it works out for you,
