A Lesson Learned the Hard Way

I was hunting an old wooded site here in Solvay, NY and I was on village property (probably should not have been here)...I got into the detecting, and without realizing it, strayed onto private property that was still wooded (when your in the woods, it is hard to tell where exactly your at)...All of a sudden, someone grabs me by the back of the collar, spins me around, and points a 9mm in my face...I immediately went for my sharpened digging tool to even the score...I pressed it against the guys ribs and told him to calm down...he told me I was trespassing on private property and I explained to him that I was sorry, but I did not know I had wandered onto his land...I explained what I was doing, and that I did not mean any harm...he finally holstered his gun, as I did the same with my LESCHE...We shook hands, and both agreed to let it stand at that, and not call the cops on each other. I assured him he would not see me on his land again...Where I was is not a great area...A lot of hoodlems hang out up here at night, and he claimed he had a young daughter and he found boys and men up in the woods doing some pretty perverted things while looking down the hill at his house site...I told him I did not blame him for his concern, but next time, his victim might be just as armed as he was, and he may not fair as well as he did with me...I think it gave both of us a good lesson...Him, to let the law handle things, and me, to steer clear of places I should probably not be (even if it is an old site in the middle of the woods)...I tell ya, I am not afraid of weapons...I have handled plenty in the Army, but staring down the barrel of one is no picnic...Stay safe folks...let my lesson be your lesson...

Been there done that - staring down the barrel of a pistol is indeed no picnic. Fortunately, from his POV, it was obvious you weren't up to anything perverted or even felonious... just some whacko with one of them "detector, beeper things." I do admire your pluck.
However, I'd like to bring up the fact that, in my neck of the woods (and most other ones), a Lesche digger and a 9MM autoloader are not an even match up! Have you ever heard the saying, "When going to a gun fight - bring a gun...?" You might want to keep that in mind :)

But, you may make lemonade out of lemons on this one. After all you have the brass for it, it seems. Go back and talk to t the guy some more. Have a laugh over the whole thing and maybe he'll let you hunt there in the future. It's worth a shot (no pun intended.)
 
Well, I don't blame you for grabbing your digger, but that action MIGHT have precipitated more on his part. I believe in most states it is a felony just to point a firearm at a person, at least it is here in Idaho. From what you describe, I can understand his actions up to a point, but I think he should have at least hollered at you with pistol down, rather than grab you and point the pistol in your face. Especially as he could see you weren't up to anything too terrible. My two bits.

Instead of reaching for my Lesche I would have just grabbed my toilet paper! You must have a couple of big coils to take a knife to a gun fight?

Hey!!!...You have to work with what ya got at hand, and I was not thinking too clearly...Actually could have used some TP I think...lol...He will get his some day...just lucky I do not go up there and plant a few booby traps for him to spring...:blowup:

I did a little checking since my other post. I think any court in the land would consider his action felony assault with a deadly weapon. And it definitely is illegal to shoot trespassers just because they happened on to your ground.

Well, now it is my word against his, as there were no witnesses to the fact...
I consider it done and over with, and there was nothing up there that I was finding worth anything anyways, so I do not plan on going back...
