5/22/2014 Beach Metal Detecting to be banned in MA - UPDATE FROM Roger Barbrick

Subject: DCR detecting ban petition follow-up

First I want to thank you all again for signing the petition to stop a ban on metal detecting on Massachusetts DCR run State beaches. Please keep sharing and getting signatures.

I have been communicating by phone and email with a DCR official and we discussed a meeting he had earlier this week with the DCR Commissioner. Apparently the Commissioner is very understanding of our concerns and they assure me that their intention is not to stop us from beach detecting but to have some "control" and say over it.

Now having said that, I am cautiously optimistic but still guarded. According to the DCR, in the past permission from a supervisor was not written, and they want to have a mechanism in place where permission is provided. They want us to have to obtain "permission" from the "supervisor", and my problem is that we never had to do that before, and timing, tides etc, doesn't really fit in. I expressed that we have never had to find someone to get permission to beach hunt in the past and that I don't see the reason for it in the beach setting.

He agreed with me and stated that the beaches are really not their concern, but really the parks and the special protected sections of beaches. I stated that we understand the desire for park permission since as far as I know it was always that way anyway (correct me if I'm wrong).

I asked if we are still ok to hunt DCR beaches for now and he said that we were and that he would work on this further and continue to communicate with me. Hopefully, they will simply drop any restriction on the beach detecting and we go back to business as usual, but just in case I stated the following:

I made a suggestion that if there was a desire to ban or even control the metal detecting on DCR beaches and other property, maybe folks can get an annual permit to hunt DCR property (at no cost or minimal cost), and when the permit is given a copy of areas "off limits" and a jointly written Code of Ethics and Rules also be given to the detectorist. Anyone found not following the rules would be fined accordingly.

Now understand, this was just a suggestion that I posed in the event that they are looking to ban detecting outright on beaches and parks - nothing set in stone, but we are talking and trying to figure out a happy middle. I am trying to tread carefully so that we get the least restrictions possible for us.

They truly seem to want to work with us so both sides can be happy, but I want to continue collecting signatures and to keep everyone aware of a potential battle down the road.

Please let me know if you or anyone you know are told that they cannot metal detect on a DCR run beach.

Right now it is one step at a time, and I will communicate again with the DCR over the next couple of weeks and update you all after that.

Thanks again

Roger Barbrick

I never leave holes. And all trash I dig I put in the trash. I usually find more trash than coins.and have helped find a few lost rings.

Not true. I went to a park here in VIRGINIA LAST WEEK IT HAD PADDLE BOATS CONNOES, ETC. CAMPING SITES, CABINS, A DOG PARK AND A SIGN NO METAL DETECTORS ALLOWED. THE PARK IS ABOUT 350 ACHERS WITH A LAKE ON BOTH SIDES IT'S DEEP IN THE WOODS. THIS IS RUN BY A GROUP OF REPUBLICAN JERKS ON THE BOARD SUPERVISOR'S WHO FOR NO OTHER REASON FEEL THE NEED TO HAVE MORE RULES.
ALSO NO LOUD RADIO'S, NO ALCOHOL. NO ANYTHING JUST PAY YOUR MONEY AND GO HOME

Regulate, regulate, regulate. That's all these jerks want to do but it's ok for dogs to crap all over the park/beach. Kids and adults can dig holes on the beach til their hearts content, holes for sand castles, holes to bury people in the sand, set up umbrellas and easy ups, all those hoes are NO PROBLEM, the common denominator, no one is getting coins or rings (or trash) out of those holes. It's ridiculous, the "holes" are NOT the problem, the PERCPTION that we are "gettin rich quick" is the problem. Why does no one EVER question the hoes dug and left by kids on the beach, but as soon as you are holding a detector it's a huge issue? People can throw frisbees and footballs, fly kites and about anything else with no "permit" but we pay the same taxes to support that beach yet we have to have a permit to enjoy it the way we want to. What happened to America? I've never seen a metal detector go flying and hit someone, but I have seen frisbees footballs and kites do it numerous times. Now I'm not against flying kites or throwing frisbees and footballs, I do all that stuff too and enjoy it, what I am against is singling out one non intrusive hobby and requiring "permission" which is the step just before abolishment. The TVA started requiring a permit to detect in their swim areas a few years ago just to "control" detecting, the permit was free just simply apply, well last year they completely banned detecting for no given reason, so look out. Permits will be required for a given timeframe then they will stop issuing said permits and state that detecting is no longer allowed. Write it down, it WILL happen if the permit system starts.

I hunt a beach where permits are required LOL COME AND GET ME IF YOU CAN WALK 2 MILES DOWN THE BEACH. PAY 10.00 EVERY TIME I GO TO THIS STATE BEACH IN LONG NY THAT'S MY LIMIT I PAID TO GET IN.

until we stop expending our energy fight each other over who,s in office the ones in office no matter who will!!!!! will expend their energys finding ways to take from the divided,,, together they wouldn't have a chance BUT THAT AINT GONNA HAPPEN... we cant even have a forum on takin our rights as metal detector away without someone sayin 1 or the other should be in office. if you looked real close you would see just as in the gun situation THAT there are people of all parties that enjoy guns and md,ing.... mmmmmmmm could be just plan old AMERICANS in the persuit of happiness...... done with my tyrate. lol

Amen....Bootyhunter has it right. Mass sucks. Wife and I just got back from Florida...beaches are free....places to park are free.....In Mass you have to pay for everything. Ridiculous of the thought that you'd have to seek out someone for a permit to wade and detect? The hole you dig in the surf is almost instantly filled by wave action in the surf....whereas....those holes dug by children/adults "ON" the beach will remain that way til someone fills them in...or falls in and sprains an ankle. Why is it we have to look over our shoulders for what we love to do? Really?
